This version of our Privacy Policy applies to visitors and customers located in Canada. It supplements your rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Quebec's Act respecting the protection of personal information in the private sector (Law 25), Alberta's PIPA, and British Columbia's PIPA. Nothing in this Privacy Policy limits your statutory rights as a Canadian individual.

Olenis is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us.

4. Data Related to Subscriptions and Marketing

4.1 Subscription/Recurring Orders: If you enroll in a subscription service, we use your Order Information to manage the recurring orders and charges, and to alert you to upcoming renewals, failed payments, or changes to the service.

4.2 SMS Marketing: If you opt-in to receive text messages (SMS) from us, your phone number and consent data will be shared with our SMS marketing partner for the purpose of sending you promotional offers, cart reminders, and transactional updates. We obtain your express consent before sending commercial electronic messages, in accordance with CASL. You can opt-out of SMS marketing at any time by replying "STOP" to any of our messages or by emailing privacy@olenisrx.com.

4.3 Email Marketing: We may send you promotional emails where you have given consent. You may opt out at any time by using the unsubscribe option displayed in our emails. If you opt out, we may still send you non-promotional emails, such as those about your account or orders, on the basis of contract.

Shipping & Fulfillment: We share necessary Order Information (name, address, items) with shipping carriers (e.g., Canada Post, Purolator, FedEx, UPS, third-party logistics providers) to fulfill and deliver your order to addresses in Canada.

6. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than Canada, including the United States, in order to provide and improve the Services for you.

To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information. 7. Third-Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

8. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of 14 (Quebec) or 13 (other provinces) without parental consent where required by applicable provincial law. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

9. Security of Your Information

We implement appropriate physical, technical, and organizational security measures designed to protect your personal information against unauthorized access, alteration, disclosure, or destruction, in accordance with our obligations under PIPEDA and applicable provincial laws. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else.

In the event of a breach of security safeguards involving your personal information that creates a real risk of significant harm, we will notify the Office of the Privacy Commissioner of Canada (OPC) and affected individuals as required under PIPEDA, and the Commission d'accès à l'information du Québec (CAI) where Quebec residents are affected, as required under Law 25.

10. Data Retention

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes, or enforce other applicable contracts and policies.

When you place an order through the Site, we will maintain your Order Information for the duration of your relationship with us and for up to 7 years thereafter to comply with Canadian and provincial tax and accounting obligations, unless and until you ask us to delete this information and there is no other legal basis to retain it. Marketing data is retained until you withdraw consent or unsubscribe. Technical and analytics data is retained for up to 26 months.

11. Your Rights and Choices

Depending on your province of residence, you may have some or all of the rights listed below in relation to your personal information. These rights may apply only in certain circumstances, and in certain cases, we may decline your request as permitted by law.

Right to Access / Know: You have the right to request access to personal information that we hold about you (PIPEDA, provincial privacy laws).

Right to Correct: You have the right to request that we correct inaccurate personal information we maintain about you.

Right to Delete: Quebec residents have the right to request that we delete personal information we maintain about them under Law 25, subject to certain exceptions. Other provinces may provide a more limited right.

Right of Portability: Quebec residents have the right to receive a copy of computerized personal information that you have provided to us in a structured, commonly used technological format and to request that we transfer it to another organization, where technically feasible (Law 25, in force since 22 September 2024).

Right to Withdraw Consent: Where we rely on consent to process your personal information, you have the right to withdraw this consent at any time, subject to legal or contractual restrictions. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

Right to be Informed of Automated Decisions (Quebec): If we use your personal information to render a decision based exclusively on automated processing, Quebec residents have the right to be informed and to submit observations.

Right to Opt-Out of Sale or Sharing for Targeted Advertising: You have the right to opt out of any "sale" or "sharing" of your personal information for targeted advertising purposes. If you visit our website with the Global Privacy Control opt-out preference signal enabled, we will treat this as a request to opt out for the device and browser that you use to visit the website.

Authorized Agent: In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

Non-Discrimination: We will not discriminate against you for exercising any of these rights.

12. International Transfers

Please note that we may transfer, store, and process your personal information outside of Canada and your province of residence, including in the United States, where our service providers operate.

While in another jurisdiction, your personal information may be subject to the laws of that jurisdiction, including lawful access by foreign authorities. We use contractual safeguards (including data processing agreements and standard contractual clauses where appropriate) to require comparable levels of protection. Quebec residents are informed, as required under Law 25, that personal information may be transferred outside Quebec; you may obtain further details, including a list of countries to which transfers occur, by contacting privacy@olenisrx.com.
